Notice of Disbarment - Ming Joe Fong

On June 25, 2012, a Resignation Committee of the Benchers of the Law Society of Alberta granted the application of Ming Joe Fong to resign pursuant to section 61 of the Legal Profession Act, R.S.A. 2000, c. L-8. Mr. Fong is therefore disbarred.

Mr. Fong was a suspended member of the Law Society. He lives in Calgary, Alberta where he practised from June 10, 1983 until December 6, 2011 when his membership was suspended on an interim basis by resolution of the Benchers.

Mr. Fong faced a discipline hearing on six citations at the time of his resignation application.  The citations alleged Mr. Fong breached trust conditions, breached undertakings, failed to serve his clients and failed to respond to opposing counsel.  In addition, Mr. Fong was the subject of further reviews of his conduct including his assistance to a client seeking to secure her alleged interest in an alleged inheritance in what is referred to as “the Spanish Estate” by asking other clients to loan money to her without full disclosure and without conducting any due diligence into the legitimacy of his client’s claims.

Mr. Fong admitted facts to support the citations and his role in the Spanish Estate.  Mr. Fong also admitted making misrepresentations to the Law Society and failing to be candid with lenders, other parties to real estate transactions, and his law partner Sandra Albus.

The Statement of Facts containing the foregoing admissions has been attached to Mr. Fong’s roll.  A copy of it may be obtained from the Law Society upon request.

The Resignation Committee directed the Law Society to publish this notice in the Calgary Herald, a local Chinese language newspaper, and in any other journal deemed appropriate by the Law Society in consultation with the custodian John Kong.

The Resignation Committee directed Mr. Fong to pay the actual costs of the discipline proceedings of $11,863.68 and the resignation application, estimated at $3,276.00, prior to any application for re-admission.

The Resignation Committee further directed, in accordance with section 78(6) of the Legal Profession Act, that the Executive Director send a copy of the hearing record to the Minister of Justice and Attorney General.
