The use of Artificial Intelligence (AI) platforms is becoming increasingly popular, and it is important to understand the terms and conditions associated with their use. This article discusses the terms and conditions of several popular AI platforms.
Many AI platforms are available in free, paid and enterprise versions. This is a critical distinction since free versions are often more limited in their capabilities while making greater use for themselves of information contributed by users.
The free version of several major AI platforms use user data to train their model. They claim the right to access user data to, among other things, maintain, develop and improve the services; comply with applicable law; and enforce their terms and policies. Enterprise versions often claim they do not use user data for training purposes but the service provider can use customer content to enforce their own policies, indicating that they can and do access such data.
In some cases, AI platforms claim that when customers submit or post content to the service, they grant the provider the right to use, modify, reproduce and distribute such content on and through the service. One platform claims the right to access user data and postings, including the right to make, use, sell, reproduce, publish, modify, adapt, prepare derivative works from, combine with other works, translate, distribute, display, perform, and sublicense postings in any form, medium or technology now known or developed in the future.
One platform provides warranties as long as customers abide by their terms and conditions. Other platforms are provided “as-is” and offer no protection against copyright infringement of third-party rights. Liability coverage may be limited to the amount paid for the service by the customer. Other platforms caution that they are provided on an “as-is” basis and do not represent the services to be free of errors.
It is important to understand the terms and conditions associated with the use of AI platforms. They vary between platforms and can include the use of user data, access to user data, ownership of content, and warranties. It is important to carefully review the terms and conditions before using any AI platform and consider your obligations to protect client confidentiality and privilege.
